The erstwhile Ramanathapuram district of Tamil Nadu (now divided into three parts: Ramanathapuram, Sivagangai and Virudhunagar) has several water bodies - such as natural lakes, man-made tanks, irrigation tanks, drinking water ponds, cattle tanks and wells. The old Ramanathapuram district had very little rainfall and was considered a dry region. Most of the agricultural land was non-irrigated and had to depend on the monsoon for cultivation. To solve the water problem there was no other option for the citizens and the rulers but to keep digging. Excavation activity continued throughout the year. Water sources were the livelihood of people and animals there.
As the population grew and new settlements were established, water sources were depleted. Land encroachments started. Slums began to be built on the banks of water sources. Another will arise in the coming days. With the spread of encroachment, water resources will begin to diminish. When oceans expand, coastlines recede, called land erosion.
Not to snatch but to wear
These two terms encroachment and erosion also apply to human freedom. Freedom in a free country will not be pulled at midnight. It slowly creeps up on you and one day you realize that you are no longer as independent as you used to be. By the time you realize that your freedom has been taken away, it is so late that it is difficult for you to get it back.
Don't live under the illusion that you won't lose your freedom. Enumerate the other countries that became independent along with India in 1947 and subsequent decades. Now count how many of these countries have lost their independence not to outside invaders but to their own autocrats. Many of these countries still have election commissions and hold elections. There is Judiciary and Judges, Parliament and MPs, Cabinet and Ministers and also Newspapers and Journalists. But when you visit or live in such a country, you realize that it is not an independent country. The country is labeled an independent country, but is run by authoritarian rulers. Sweden's V-Dam organization has given different names to nations. Such as a nation with liberal democracy, elected democracy, elected autocracy and suppressed autocracy. In 2021, it classified India as a country with elected autocracy. This is an embarrassing title.
Quick fix
Articles 14 and 19 (1) (a) and (g) of the Constitution protect the freedom of the individual and the press. Remember April 6, 2023. A dubious amendment to curtail press freedom was approved today. During the crisis period of 1975 to 1977, freedom of the press was withdrawn overnight. (This was a wrong move and late Indira Gandhi even apologized for it). On April 6, the government has amended the Information Technology Rules, 2021. Rule 3(1) (b)(v) after amendment reads as follows.
3(1) Precautions to be taken by an intermediary: An intermediary including social media, known social media intermediaries and online gaming intermediaries shall take the following precautions while performing their duties. Such as:
(b) the intermediary concerned shall... give notice to the users of its computer resources that it shall not display, upload or publish or alter any information in connection with any work of the Central Government or knowingly or intentionally furnish any false information which would cause the recipient of the message to Its original source matter may be misleading or deceptive.
The amended rule deals with 'any business of the Central Government'. There will be a central government unit for fact-checking. This is a polite name for an official censor. This sensor will be empowered to detect whether the reports are true or false. If any news is found to be false, newspapers, TV channels and social media outlets will have to instruct the users of their computer resources to remove the relevant news.
I do not want to use this column to say whether there is any legal flaw in this rule. Suffice it to say, it is in the hands of the government to decide what is right and what is wrong, to operate and to judge.
The above amended rule has a history. Several obligations have been imposed on intermediaries through the Information Technology Rules enacted in 2021. These rules have been challenged in various courts. On October 28, 2022, the government promulgated the Information Technology (Intermediary Guidelines and Digital Media Code of Ethics) Rules, 2022 and made the first significant amendment in Rule 3(1)(b) (five). Now on April 6, 2023, Rule 3(1)(b) (five) has been amended again which I regard as an erosion of liberty.
Let the court decide whether the amended rules are legal, but we are looking at the non-legal and libertarian aspects.

- Won't this step of the government stifle freedom of speech?
Precious rights are dying. Wake up before rights are taken away.
